Standard TERMS & Conditions Of TECTONIC DIGITAL SYSTEMS LTD
1: In the following paragraphs the company shall mean TECTONICDIGITAL SYSTEMS LTD and the customer shall mean any person, company or organisation which places an order on the Company for the supply of materials and / or services will be subject to the following conditions which shall form the basis of the Contract between the Customer and the Company. The company intends to rely upon the written terms set out here on this document. If you require any changes, please make sure you ask for these to be put in writing. In that way, we can avoid any problems surrounding what the Company and you the Customer is expected to do.
2: Except where standard bulk-rate prices have been negotiated between the Company and the Customer , the Company will assess each job and quote for the work considered to provide the best quality reception of television , satellite or radio signals in the prevailing reception conditions. A further assessment will be made on completion of the work and further recommendation made where appropriate.
3: The Customer is asked to examine the goods as soon as reasonably possible after delivery and notify the Company of any fault or damage as soon as reasonably possible.
4: The Company undertakes to maintain insurance cover against Public and Employers liability for an amount not less than £5,000,000 & 10,000,000 respectively in any one claim.
5: The Company reserves the right to decline to carry out work which it considers unsafe, and in such circumstances we will give you a full written explanation of the adverse conditions encountered. We will also refund all money deposited by you.
6: A guarantee relating to the work will be issued after completion of the work and all monies due to the company have been paid. The guarantee is issued in addition to and not in substitution for the customer’s statutory rights relating to faulty or misdescribed goods or services. The Company cannot guarantee against damage caused by vandalism , gales or lightning.
7: The Company draws to the attention of the Customer the following recommendations of the BBC regarding the installation of UHF aerials in lofts. “ The television and radio transmitter networks have been carefully planned to make the best use of the frequencies available. The plan assumed that a good aerial mounted outside will be used for television or VHF stereo radio in the home. Loft mounted aerials may sometimes be suitable for VHF stereo radio but indoor aerials are never recommended for television”. In all cases the fitting of an aerial in a loft will adversely affect the quality of reception obtained. Although the Company will make every effort to obtain satisfactory reception , it cannot guarantee the results from aerials so sited. Please note that we don’t recommend the installation of TV aerials for digital signals in lofts.
8: In general the Company will direct aerials towards the transmitter designated by the BBC and ITC to serve the area in which the property is situated.Where the Customer specifically requests reception from an out of area transmitter the Company will make every effort to obtain satisfactory reception but reserves the right to make a service charge if reception proves unacceptable.
9: Except for approved trade account , terms are strictly cash on delvery by BACS, Cash or Cheque payment. All such invoices are strictly net and unless otherwise agreed by the Company are due for payment within seven days of receipt of the invoice. Interest charges will be made to all over due balances of 3% above the Bank of England Base rate.
10: Any dispute under or arising out of any Order accepted by the Company which cannot be satisfactorily resolved between the Company and the Customer will have the option of being referred to an independent Arbitrator to be appointed by the Chairman of the C A I and the finding of the Arbitrator so appointed shall be binding on both parties.
11: Where a MATV , SMATV or Satellite IF System has been installed , the Company shall provide the Customer with a commissioning report to record the type of system a description of materials used and the signal levels achieved at the headend and at the various points throughout the development.
12: Systems shall comply with all relevant Health and Safety Standards including BS EN 50083-1 and where these Standards are not included on the specification, the Company shall advise the Customer on such applicable Standards.
13: We will make every effort to complete the work on time (or, if no date has been agreed, within a reasonable time from the date of your order) but we cannot be held responsible for delays due to weather or other circumstances beyond our control. In this case we will complete the work as soon as reasonably possible.
14: The company can’t be held responsible for service providers (ie BBC, Ch 5 , Sky & UK TV etc) change to their transmission platform, and this lies solely with the program provider & not the company.
